TERMS and CONDITIONS for Mooyah Burger & Fries Restaurant auction - Read BEFORE placing a bid! Auction Items are in TWO Locations: Lots 1-39 are located at 1060 W Mercury Blvd, Hampton VA Lots & Lots 41-67 are located at 420 W 23rd Street, Norfolk VA. Placing a bid is considered a legally binding, contractual agreement to purchase & pay for an item. Please do not place a bid unless you have read, understand and accept the Terms of this auction, including payment and pick up requirements, which are different for EVERY one of our auctions. AUTO-EXTENDED BIDDING: Our auctions feature a Simulated Live Auction Experience with staggered closings, auto-extend bidding and bid notifications. This allows items to close at a pre-determined rate of 1 item every 60 seconds. We also feature auto-extend bidding, which means that the closing time of an individual lot will be extended if a bid is placed in the last 2 minutes of the item's closing. This allows you a chance to place a final bid on an item you may have otherwise missed, and closely simulates a "live auction." If you have downloaded the Auction757 app and turned on "push notifications," you will be alerted, whenever you are outbid on an item. IN PERSON AUCTION INSPECTIONS: Monday, April 20, 2026, 9 AM - 1 PM. We want you to get the best deal possible and encourage you to inspect all items before bidding. Due to the number of items we sell, we do NOT have time to test items. All due diligence belongs to the bidder. Use the preview to determine what tools & how much assistance you will need to remove your potential purchases. If you have any questions pertaining to a specific lot, please call or text 757-818-2968, BEFORE placing a bid! If you cannot make it to the preview, but have questions on specific items, you may call or text Natalie at 757-287-8797 or Tucker at 757-818-2968, DURING THE PREVIEW, and they will be happy to send you additional info/ pictures/video of items you are interested in. WARRANTY, CONDITIONS & DESCRIPTIONS: All items are sold as-is, where-is, with NO warranties expressed or implied, and there are NO refunds given, for any reason. Please read the description & examine the photos when bidding. If there is any doubt when viewing an item, go by the description, as photographs sometimes include items that are NOT part of the lot. Most importantly, we strongly encourage you to preview the auction in person. Neither the auctioneer, nor the seller, makes any warranties or representations of any kind or nature with respect to said property. AUCTION PICKUP: Please note that all items are scheduled for pick up on April 22nd. Lots 1-39 by appointment ONLY on Wednesday, April 22nd from 9 AM - 1 PM. Lots 41-67 by appointment ONLY on Wednesday, April 22nd from 2 PM - 4:30 PM. Buyers must bring their own moving equipment and people to help load purchases. The auction staff does not help load. Once you have been notified of winning an item, the item contractually, and legally becomes yours, and any fees associated with moving, removing, disposing of, or collecting payment, whether physical or legal are your responsibility. An invoice will be emailed to successful bidders shortly after the auction ends on Tuesday, April 21st. Please schedule your pick-up appointment(s) and specify payment method BEFORE the auction ends. The smartest bidders schedule tentative appointments early, as they know that will get them in at their preferred times. You may request an appointment any time after 9 AM on Monday, April 20th by texting Natalie at 757-287-8797 with your name and your preferred pick-up time. Appointments are scheduled every 15 minutes and no more than 3-4 people can be in the restaurant to pick up, at any one time. Natalie will email your invoice shortly after the auction ends, and it will be your responsibility to text her to schedule your pick up appointment. If you do not see an invoice in your In-Box, check your Spam folder. SALES TAX: This auction is taxable. PAYMENT: Your total invoice must be paid, in full, by 4 PM Wednesday, April 22, 2026. You will receive an invoice for your total, which will include a 16% Buyers Premium (BP) for business check or credit card payments and sales tax. The BP will be discounted to 13% for cash payments. Credit/debit cards being used for payment must be saved in your Bidder Profile, as all card payments are processed online only. If you do not contact Natalie by 6 PM, April 21st, your card on file will be run and a paid invoice will be sent to your email. Please bring your paid receipt to your pick up appointment. Since placing a bid contractually binds you to paying for an item, you are required to pay for all items you bid on and win in this auction, WHETHER OR NOT you pick them up. This is a Final Sale. No refunds or chargebacks are allowed. ABANDONED ITEMS: All lots must be picked up no later than 4:30 PM on Wednesday. Items not picked up by this time will be considered abandoned. You are required to pay for all items you bid on and win in this auction, WHETHER OR NOT you pick them up. Your credit card on file, will be charged for your total balance, including the 16% Buyer's Premium and any applicable sales tax, if you abandon your purchases. Should your payment be declined, you will be banned from participating in all future auctions, and the Auctioneer will pursue legal recourse to collect the amount you owe. All attorney's fees, court costs, and other legal fees will be the responsibility of the Bidder. In addition, interest will accrue on any unpaid balance, at the rate of 12% per annum.
