TERMS AND CONDITIONS for this auction - Read BEFORE placing a bid! Placing a bid is considered a legally binding, contractual agreement to purchase & pay for an item. Do NOT place a bid unless you have read, understand and are willing to accept ALL Terms of this auction, including payment and pick up requirements (different for EVERY one of our auctions). BIDDING: Our auctions feature a Simulated Live Auction Experience with staggered closings, auto-extend bidding and bid notifications. Items will close at a pre-determined rate of 1 item every 30 seconds. We also feature auto-extend bidding, which means that the closing time of an individual lot will be extended to 2 minutes if a bid is placed in the last 2 minutes of the item's closing. This allows you a chance to place a final bid on an item you may have otherwise missed, and closely simulates a "live auction." If you have downloaded the Auction757 app and turned on "push notifications," you will be alerted, whenever you are outbid on an item. IN PERSON AUCTION INSPECTION: Monday, September 14th, 9 AM - 1 PM at 941 Laskin Road, Virginia Beach, VA 23451. We want you to get the best deal possible and encourage you to inspect all items before bidding. Due to the number of items we sell, we do NOT have time to test items. All due diligence belongs to the bidder. Use the preview to inspect every item of interest and determine what tools & how much assistance you will need to remove your potential purchases. WARRANTY, CONDITIONS & DESCRIPTIONS: All items are sold as-is, where-is, with NO warranties expressed or implied, and there are NO refunds given, for any reason. Please read the description & examine the photos when bidding. If there is any doubt when viewing an item, go by the description, as photographs sometimes include items that are NOT part of the lot. Most importantly, we strongly encourage you to preview the auction items in person. Neither the auctioneer, nor the seller, makes any warranties or representations of any kind or nature with respect to said property. AUCTION PICKUP: By appointment ONLY, the day after the auction: Wednesday, September 16th, 9 AM-4PM. ALL appointments must be scheduled through our ONLINE Sign Up Genius app. Specific pick up times are required for some items. Read each item's description carefully for special instructions, in case it does not follow our general guidelines, as follows: In general, most small items must be picked up before noon, as they are displayed on top of tables & shelves; tables and shelving must be picked up after noon. Buyers must bring their own tools, equipment and labor/helpers to disconnect, remove and load their own items. The auction staff does not help load auction purchases. Once you have been notified of winning an item, the item contractually, and legally becomes yours, and any fees associated with moving, removing, disposing of, or collecting payment, whether physical or legal are your responsibility. An invoice will be emailed to successful bidders shortly after the auction ends. Read the instructions on your invoice. We provide all the info you need to have the best experience possible. You may schedule a pick-up appointment as soon as you know you've won an item. The smartest bidders schedule appointments ASAP, as they know that will get them in at their preferred times. Appointments are scheduled through Sign Up Genius. The link will become active beginning at 10:30 AM on auction day. Natalie will email your invoice shortly after the auction ends. If you do not see an invoice in your In-Box, check your Spam folder or search for Info@Auction757.com. SALES TAX: This auction will be subject to 6% Virginia Sales Tax. PAYMENT: Your total invoice must be paid, in full, online, if paying by cc or at the time of your appointment, if paying by cash or business check. Your invoice will assume you are paying by cash, for the discount, so it automatically includes a 13% Buyers Premium (BP). If you prefer to pay by business check or credit card payment, your BP will be 16% (the additional 3% will be shown as an Admin Fee). Credit/debit cards being used for payment must be saved in your Bidder Profile, as all card payments are processed online only. If you wish to pay by cc, please click the link in your invoice, and please bring your paid receipt to your pick up appointment. Since placing a bid contractually binds you to paying for an item, you are required to pay for all items you bid on and win in this auction, WHETHER OR NOT you pick them up. If you do not show up on pick up day, your card on file will be run for the entire amount you owe, including the 16% BP. This is a Final Sale. No refunds or chargebacks are allowed. ABANDONED ITEMS: All lots must be picked up no later than 5 PM on Wednesday. Items not picked up by this time will be considered abandoned. You are required to pay for all items you bid on and win in this auction, WHETHER OR NOT you pick them up. Your credit card, on file, will be charged for your total balance, including the 16% Buyer's Premium, if you abandon your purchases. Should your payment be declined, you will be banned from participating in all future auctions, and the Auctioneer will pursue legal recourse to collect the amount you owe. All attorney's fees, court costs, and other legal fees will be the responsibility of the Bidder. In addition, interest will accrue on any unpaid balance, at the rate of 12% per annum.
